Welcome to Post ("App", "we", "us", or "our"), operated by Post Spatial, LLC. These Terms and Conditions ("Terms") govern your access to and use of the App, including any associated mobile applications, features, and services.

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the App.

1. Eligibility and Account Registration

Eligibility: You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction) to use the App. By using the App, you represent and warrant that you meet this requirement.

Account Creation: Anyone may view publicly accessible content, but you must register for an authenticated account to post, or interact with digital images, icons, or messages ("User Content").

Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or breach of security.

2. Location-Based & Augmented Reality (AR) Safety

Because the App interacts with real-world geographic locations, you acknowledge and agree to the following rules of engagement:

  • Real-World Awareness: Always remain aware of your physical surroundings while using the App. Do not operate mobile devices or use the App while driving, cycling, operating machinery, or in hazardous environments.
  • No Trespassing: You agree not to enter, anchor content within, or direct other users toward private property, restricted government zones, hazardous areas, or any location where you do not have explicit authorization or legal right of access.
  • Assumption of Risk: You assume all risks associated with traveling to, navigating around, or interacting with physical locations associated with content viewed through the App.

3. User Content and Conduct

Public Nature of Content: Any text, image, icon, or data you anchor to a physical location is public and visible to other users who access that location through the App. Do not post personal sensitive data, private credentials, or confidential information.

Prohibited Content: You may not post, anchor, or transmit content that:

  • Is unlawful, defamatory, harassing, abusive, threatening, obscene, or hateful.
  • Infringes upon any patent, trademark, copyright, trade secret, or privacy right of any party.
  • Depicts or promotes violence, self-harm, illegal acts, or dangerous activities.
  • Contains malicious code, spyware, or harmful scripts.
  • Intends to stalk, track, or harass specific individuals at physical locations.

License Grant: You retain ownership of your User Content. However, by posting content on the App, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, display, reproduce, modify, and distribute your content across the platform.

4. Content Moderation and Removal

Right to Monitor: We reserve the right, but not the obligation, to monitor, review, flag, modify, or remove any User Content at our sole discretion, with or without notice, if it violates these Terms or applicable laws.

Reporting Mechanism: Users can report offensive, infringing, or dangerously placed content through the in-app reporting tool or by contacting us directly.

Account Termination: We reserve the right to suspend or permanently terminate your account and access to the App if you violate these Terms.

5. Intellectual Property Rights

All rights, titles, and interests in and to the App (excluding User Content), including underlying software, user interfaces, branding, visual assets, and algorithms, remain the exclusive property of Post Spatial, LLC and its licensors.

You may not reverse engineer, decompile, copy, or create derivative works from the App's source code or proprietary technology.

6. Copyright Infringement (DMCA Notice)

If you believe that any content anchored or displayed within the App infringes upon your copyright, please submit a written notice to our designated agent at report@get-post.co containing:

  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material to be removed, including specific coordinates or location descriptions.
  • Your contact information (name, address, phone number, and email).
  • A statement made in good faith that the disputed use is unauthorized.
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.

7. Disclaimers and Limitation of Liability

"As Is" Basis: The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including accuracy of geolocation data or uninterrupted availability.

Limitation of Liability: To the maximum extent permitted by applicable law, Post Spatial, LLC, its affiliates, officers, and employees shall not be liable for any indirect, incidental, punitive, or consequential damages, or for any personal injury, property damage, or trespassing claims arising out of your access to or use of the App or your interactions with physical locations.

8. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, USA, without regard to conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the state or federal courts located in Los Angeles County, California.

9. Modifications and Contact

Updates: We may update these Terms periodically. Continued use of the App following the posting of revised Terms constitutes your acceptance of the changes.
